What’s involved in buying a property at auction?
Unlike traditional property purchases, buying at auction means you are legally committed to the sale the moment the hammer falls. There’s no option to change your mind or renegotiate once the auction ends, so it’s essential to be fully prepared before you bid. This includes reviewing the legal pack in advance, understanding any risks or obligations, and having your finances in place for immediate exchange and a fixed completion date—usually 28 days after the auction.
What is the legal pack?
The seller will provide a legal pack in advance of the auction, which typically includes the title deeds, searches, special conditions of sale, lease (if applicable), and other important documents. You should have a solicitor review this pack thoroughly before the auction to identify any potential legal issues, such as restrictions, charges, or unusual clauses that could affect your use or ownership of the property.

What happens if you win at auction?
If your bid is successful, you’ll exchange contracts immediately and will usually need to pay a 10% deposit on the day. Completion will normally take place within 28 days, during which time your solicitor will carry out any final checks and prepare the necessary documents to complete the transaction. There is no room for delay at this stage, so having a solicitor in place and ready to act is vital.
Can you buy at auction with a mortgage?
Yes, you can, but it’s important to have your agreement in principle in place before the auction and be confident that the property is mortgageable. Some auction properties may be unmortgageable due to condition or legal issues—this is something we’ll assess when reviewing the legal pack. Because of the tight timeline between exchange and completion, you’ll need to act quickly to finalise your mortgage offer once you’ve won.
How long does the process take?
From the point of winning the auction, you’ll usually have 28 days to complete. However, legal preparation should begin as soon as you’re interested in a property—ideally two to three weeks before the auction date. We can work with you to review legal packs quickly and advise whether the property is a suitable and safe investment.
Do you need a solicitor to buy at auction?
Yes. Given the speed, complexity, and risks involved in auction purchases, having a solicitor is essential. A solicitor will review the legal pack before the auction, advise you on any red flags, and manage the legal process between exchange and completion after the auction. Without proper legal advice, you could end up committed to a property with serious issues or costs.
